Carlos M. Lazatin


Carlos Lazatin is a partner in O’Melveny’s Los Angeles office and a member of the Class Actions, Mass Torts, and Insurance Litigation group and the Intellectual Property and Technology group, with a particular focus on consumer product litigation. Carlos has also served as Chair of the Associates & Counsel Advisory Committee in Los Angeles.

Carlos has extensive experience defending clients in class action and consumer products cases. He drafted a successful opposition to certification of a nationwide class in multidistrict products liability litigation brought against one of the nation’s leading manufacturers of health care products. Carlos has also represented a prominent consumer products company in false advertising lawsuits over America’s number one brand of no-calorie sweeteners, and has defended a number of clients in actions brought under California’s unfair competition and false advertising statutes. Carlos is currently handling class action claims for false advertising and unfair competition involving a range of consumer products—from toning shoes to green tea.

Carlos has also represented clients in a number of copyright, trademark, and intellectual property disputes. He obtained a directed verdict on behalf of the maker of America’s most popular line of fashion dolls in a copyright, trademark, and trade dress lawsuit involving alleged infringement of plaintiff’s t-shirt designs. He was also instrumental in the successful defense of a video game developer in a much-watched copyright infringement case involving novel applications of the fair use doctrine and secondary liability on the Internet. Carlos also represented plaintiffs in a trademark and trade dress lawsuit over defendant’s infringing CD cover design.

Carlos has briefed matters before the U.S. Supreme Court, the U.S. Courts of Appeals for the Eighth and Ninth Circuits, the Florida Supreme Court, the California Supreme Court, the California Court of Appeal, various U.S. District Courts, and the California Superior Court. Carlos has also argued matters before the Ninth Circuit Court of Appeals, the U.S. District Courts for the Central and Southern Districts of California, and the California Superior Court.

Carlos has tried over half a dozen misdemeanor criminal trials to verdict as a volunteer prosecutor for the City of Redondo Beach and as a student prosecutor for the Commonwealth of Massachusetts.

Prior to attending law school, Carlos worked in brand management at General Mills, Inc.
