O’Melveny won an important victory for US Airways in the DC Circuit. Former pilots brought suit claiming that the airline violated ERISA when it terminated their disability benefits after they were furloughed. Despite the fact that the matter had been pending for eight years while handled by another firm, O’Melveny successfully moved to dismiss the lawsuit in the district court on the grounds that the Railway Labor Act trumps ERISA under the circumstances. The DC Circuit affirmed the decision.
