Climate Change

Climate change increasingly is shaping the international business environment. State and local governments are working individually and collectively to reduce emissions of greenhouse gases. There is mounting pressure to address climate change at the federal level. Climate change resolutions dominate the shareholder dialogue at public concerns and financial institutions are increasingly subject to environmental, social and economic guidelines. The commercial sector is actively working on compliance with carbon limits which have emerged from the Kyoto accords and comparable regional laws and regulation. These same accords together with tax and other financial incentives have created a busy marketplace for alternative energy and clean energy technology (Cleantech). Companies are also facing climate change-related lawsuits for the first time.

O’Melveny's Climate Change practice is an interdisciplinary group of practitioners who have substantial knowledge of climate change issues across legal disciplines, industry sectors, and continents. Our practice includes litigators and transactions lawyers who counsel clients on a wide range of matters involving greenhouse gas emissions, renewable energy technology and related investments. Our Climate Change practice works closely with, and draws on the strengths of, O’Melveny’s Energy, Natural Resources and Environment (ENRE) Practice and our Clean and Renewable Energy Practice. 

Beginning with the Kyoto accord requirements, and continuing with more recent domestic initiatives such as the Regional Greenhouse Gas Initiative (in the northeast United States), the Western Climate Initiative (involving western states, parts of Mexico, and the Canadian provinces) and AB 32 (in California), our lawyers have been working with and shaping efforts to regulate greenhouse gas emissions abroad and at home since their inception. Among the more prominent of these projects, O’Melveny is making a significant impact in this developing area of law by assisting Edison International’s efforts at the federal and state levels to shape greenhouse gas policy in the United States.

We have been on the front-line of greenhouse gas tort litigation in the United States. These cases raise novel issues of causation, jurisdiction and land use policies which potentially will affect companies across a wide range of industries.

We also are helping many of our clients develop technological solutions to climate change. We have advised on numerous renewable and alternative energy projects, including hydro-electric, solar, wind, geothermal, biofuel, waste-to-energy, and landfill gas projects. We have also represented interests in the zero emission vehicles market. Our recent work includes representing major oil companies, financial services companies and investors in important litigation, regulatory, and transactional matters, including the negotiation of more than US$2 billion in wind turbine acquisition agreements.

Three significant achievements of this initiative include being among the first law firms to achieve nationwide compliance with the ABA-EPA Law Office Climate Challenge Best Paper Practices program, attaining 100% usage of wind power in our New York office, and the recent move of our San Francisco office into a new building that achieved Gold certification through the US Green Building Council’s LEED program for commercial interiors, making O'Melveny the first law firm to have achieved a Gold rating—the next-to-highest rating possible in the LEED scale—for renovated space in an existing building.

This fund aims to exploit the significant investment opportunities in Europe arising from the legally binding European targets for renewable energy supply.
  • Our clean tech experience covers solar, wind, geothermal, biomass and synfuels, waste-to-energy, landfill gas, coal gasification, and zero emission vehicle projects and includes all related regulatory licensing and approval matters. Our lawyers are engaged in early stage and mature alternative energy finance and M&A transactions including the successful IPO of China Sunergy Co., Ltd on the Nasdaq Global Market exchange. Additionally, our intellectual property staff regularly works on patent prosecution and protection with regard to alternative energy technology.
  • O’Melveny has embarked on a program of charitable contributions to reduce its carbon footprint. For example, since 2006, we have contributed to the Rainforest Alliance (RA), an international nonprofit organization that leads efforts to certify sustainable forestry, agriculture, land use, and business practices. We also work with RA on numerous pro bono projects, including international policy affecting the use of forests and carbon sequestration to create carbon credits. In addition, we represent pro bono client Forest Stewardship Council in various certification and carbon sequestration projects.
  • O’Melveny donated a 672 acre Grenada Hills park to the city of LA which maintains the same. The park was formerly owned by Firm founder John O'Melveny.
