Parker to Speak at FTC's "Unilateral Effects Analysis and Litigation Workshop"

O'Melveny partner Rich Parker has been invited by the Federal Trade Commission to participate in the "Unilateral Effects Analysis and Litigation Workshop," to be held February 12th in Washington, D.C. The workshop will examine the application of unilateral effects theory to mergers of firms that sell competing, but differentiated, products. Parker's panel will examine the role of market differentiation in the trial unilateral effects analysis and in the litigation of unilateral effects cases. The panel will also address:
- Is it sufficient to infer a relevant market from direct evidence of competitive effects?
- As a matter of policy and law, does a relevant market need be identified at all when there is direct evidence of competitive harm?
