Deaton and Kidder Publish Article on Practice Management Arrangements for Hospitals & Health Systems Rx
O'Melveny partner
David Deaton and counsel
James Kidder co-authored an article, "Practice management Companies—Practice Pointers from Recent Case Law,"
that was published in the June 2008 issue of Hospitals & Health Systems Rx.
In their article, Deaton and Kidder note that while practice management arrangements in which healthcare professionals contract with corporations for a broad range of management services remain common, there is continuing legal uncertainty in many states regarding whether the arrangements comply with laws governing the corporate practice of medicine, dentistry and other healing arts professions.
The authors provide six tips for healthcare practice management companies, based on recent case decisions:
- Do Not Exercise Control Over Professional Decision-Making
- Know Your Potential Plaintiff
- Consider the Scope and Character of Services
- Do Not Exercise Indirect Control of Healthcare Professionals
- Consider Critically "Captive PC" or "Friendly PC" Models
- Carefully Review Advertising and Other Public Representations
