Law360: NY Jury Clears CR Bard Of Unlawful Catheter Tying Claims

CR Bard Inc. was cleared by a New York federal jury of claims that it violated the Sherman Act by tying its tip location systems and peripherally inserted central catheter together. The verdict ended a five-year legal dispute between Bard and its competitor AngioDynamics Inc. “We and Bard are pleased that the jury has found that Bard’s design and sale of its market-leading PICC products do not violate the antitrust laws,” Bard’s counsel Andrew Frackman said. Bard is represented by Frackman, Mark Racanelli, Pamela A. Miller, and Sergei Zaslavsky of O’Melveny & Myers LLP.
