Law360: Poultry Execs Move For Acquittal Amid Price Fixing Retrial

Ten chicken executives filed individual motions asking a Colorado federal court for judgments of acquittal in a retrial over price-fixing conspiracy charges. The executives contend that the government’s documents and witnesses failed to show any evidence of a scheme to fix chicken prices. Former Pilgrim’s Pride CEO Jayson Penn argued that the government’s witness from his company, Robbie Bryant, testified that Penn had no knowledge of any agreements to fix prices or rig bids. “The balance of the documentary evidence involving Mr. Penn is similarly consistent with lawful conduct,” the motion said. “No rational jury could find Mr. Penn guilty beyond a reasonable doubt by relying on it.” Jayson Penn is represented by Michael Tubach, Anna Pletcher, and Brian Quinn of O’Melveny & Myers LLP.
