Publishers Weekly: In Final Briefs, DOJ, PRH Flesh Out Arguments Ahead of Trial

Final briefs have been filed for the Aug. 1 trial involving Penguin Random House’s acquisition of Simon & Schuster and the US Department of Justice’s effort to halt the US$2.2 billion purchase. Daniel Petrocelli, the lead attorney for Penguin Random House and Bertelsmann, which owns Penguin, has argued in briefs that the merger will “enhance competition” and create “efficiencies that will enable the combined entity to make better offers to more authors” as well as “incentivize other publisher to compete harder to acquire the books they, too, need to win sales among consumers.”
