Reuters: O’Melveny, Arnold & Porter Defend Penguin Random House in DOJ Antitrust Case

O’Melveny’s Daniel Petrocelli will serve as lead trial counsel for Penguin Random House LLC in a lawsuit filed by the US Department of Justice filed to block the publisher from acquiring its rival Simon & Schuster Inc. Petrocelli, O’Melveny’s vice firm chair, served as lead trial counsel to AT&T and successfully defended its acquisition of Time Warner Inc in 2019 for US$85 billion. The DOJ said that the US$2.7 billion deal would give Penguin Random House “outsized influence over who and what is published, and how much authors are paid for their work.” In a statement from Penguin Random House, Petrocelli said that the DOJ’s lawsuit was “wrong on the facts, the law, and public policy.”
