The Citizen’s Voice: Judge Concludes School Funding System in Pa. is Unfair, Violates State Constitution

Commonwealth Court Judge Renée Cohn Jubelirer issued a decision on Tuesday that declared Pennsylvania’s public school funding system as unconstitutional, concluding that “students attending low-wealth districts are being deprived of equal protection of law.” The lawsuit, which was brought by six school districts, two civil rights groups, and several parents, was originally filed in 2014 and claimed that Pennsylvania’s funding model violated the education clause and equal protection provisions in the state’s constitution. According to the plaintiff’s lawyers, 86% of Pennsylvania students were in school districts that were inadequately funded. The plaintiffs are represented by the Public Interest Law Center, Education Law Center, and O’Melveny and Myers LLP.
