Pennsylvania’s public education funding system was declared unconstitutional by Commonwealth Court President Judge Renée Cohn Jubelirer on Tuesday, concluding that schools are not equitably financed by the state. The long-awaited decision follows a landmark lawsuit that concluded last year and consolidated a seven-year process into a four-month trial. The petitioners, which included advocacy groups, several parents, and six school districts, sued the state over claims that the funding formula discriminates against students in low-income districts. The Education Law Center, the Public Interest Law Center, and O’Melveny & Myers LLP represented the petitioners, highlighting the state’s inability to provide a “thorough and efficient: education for its students.
