Patent and Technology Litigation

Because intellectual property protection is so important in today’s technology- and information-based economy, companies increasingly find themselves in court enforcing, or defending, their patent and technology rights.  As a result, it is crucial to have experienced trial lawyers who are well-versed in the intricacies of patent and trade secret law and policy and can explain the underlying technology to judges and juries.

O’Melveny’s patent and technology litigators have the forensic and technical skills, and the industry and professional experience, needed to tackle the most demanding intellectual property disputes.  For decades, we have prevailed in must-win cases, including our representation of NDS Group PLC, a subsidiary of News Corp., in a technology-intensive, multi-billion dollar case, successfully defeating plaintiff's claims in a six-week jury trial, and recovering fees and costs in an appeal to the Ninth Circuit.  We litigate patent and technology matters in forums around the nation, both at the trial and appellate levels, including Section 337 proceedings before the International Trade Commission.  We also coordinate and supervise parallel proceedings outside of the United States, to resolve intellectual property controversies that increasingly traverse countries and continents.
