Insurance and Reinsurance

Insurers and reinsurers increasingly face complex, protracted litigation and arbitrations with far-reaching implications and significant monetary value. Success in these matters requires a law firm with established expertise in insurance and reinsurance disputes.

O’Melveny’s insurance and reinsurance practice combines over 75 years of experience with forward-looking innovation. We provide litigation, arbitration, and transactional services to such notable insurance companies as ACE, CIGNA, GEICO, MunichRe, Northwestern, and Zurich. Our team handles disputes involving insurance coverage company practices, regulatory issues, ERISA issues, reinsurance claims, mutual funds, securities, and criminal defense. For example, in the aftermath of September 11th, we represented Zurich in a jury trial against a disputed coverage claim filed by Silverstein Properties Inc. for more than US$1.13 billion in coverage for the World Trade Center. We also scored a victory for ACE and CIGNA in their decade-long battle over CIGNA’s restructuring, and recently won the highly publicized trial victory for Century Indemnity against Congoleum Corporation in a major asbestos case.

We represent clients worldwide under various international arbitration regimes–including the English Arbitration Act, Hong Kong, CITAL, ICC, UNCITRAL, and AAA rules–and have achieved success in almost every international procedural and industry setting.

Our regulatory litigation work includes state commission insurance hearings related to hostile takeovers, constitutional challenges to state laws and regulations, and voter-passed initiatives. We are well-versed in handling complex actuarial cases involving reinsurance and other risk transfer. Our experience includes litigating a case concerning the commutation of reinsurance involving environment and asbestos liabilities. We are also experienced in litigating novel and complex insurance products and agency relationships.

On the transactional side, we address insolvencies, liquidations, and financially distressed situations for insurers and reinsurers. Our recent experience includes the restructuring of two major insurance companies.

Combining broad experience and strategic planning skills with highly efficient execution, international collaboration, and targeted budgeting, we achieve the best possible total cost outcomes for clients. Our team excels in complex matters with significant repercussions, successfully handles precedent-setting trials and appeals, and has earned a first-rate reputation among insurance and reinsurance companies alike.

Practice Strengths

  • Alternative Dispute Resolution
    • We have participated in significant ADRs with the most prominent mediators in the United States and United Kingdom.
  • Antitrust
    • We have represented insurance companies in antitrust investigative proceedings, including: litigation in the US Supreme Court alleging a conspiracy between the London market and US insurers to deny insurance to doctors and municipalities; an antitrust investigation of multiple insurance companies charged with conspiring to evade California Proposition 103 that was conducted by the California Attorney General; an antitrust suit in the U.S. District Court in Colorado alleging conspiracy to deny coverage and alleging a boycott of the insured; and litigation in New Jersey and Australia involving state and federal antitrust claims arising out of global insurance policies.
  • Appellate
    • We collaborate closely with our nationally renowned appellate practice, and recently prevailed in a long-running case involving uninsured motorists coverage for clients Ford Motor Credit and Michigan Mutual Insurance Company.
  • Environmental and Asbestos Claims
    • O’Melveny has been involved in virtually every major environmental and asbestos coverage action in the past 30 years. We have obtained leading coverage decisions for many major insurance companies, have been successful in jury and bench trials in Iowa, New Jersey, New York, and various other states, and have experience representing insurers and reinsurers in appeals to state and federal appellate courts.
  • Global Reach
    • Our practice spans the UK, continental Europe, and Asia. Our lawyers in London and Brussels are experienced practitioners of various national laws and procedures and are qualified in most EU member states. We were named "China Practice of the Year" in 2006 by Asian Legal Business magazine, and Asia-Pacific Legal 500 described our litigation practice as a “disputes juggernaut; one that is well placed to handle the most complex and high-profile cases.”
  • Health Care
    • We are experienced in representing health insurers, including CIGNA, Wellpoint, Humana, and HCA. In one matter, we defended our client against a multi-count federal antitrust case brought by a high-deductible health care insurance company alleging price fixing and group boycott. This case marked a significant victory for our client as it defends similar cases nationwide.
  • Trials
    • Some of our recent jury and non-jury trial victories include: a nine-month jury trial for an insurance company in California; a New Jersey coverage case where New Jersey state was the plaintiff; and a US$127 million recovery (including prejudgment interest) in a jury trial in New York state court.
