Xin-Yi (Vincent) Zhou is an experienced intellectual property litigator. Vincent focuses his practice on representing technology companies in high-stakes, complex cases involving electronics, semiconductor, telecommunications, and software technologies. Before attending law school, Vincent worked as a product engineer for AMD and as a process engineer and program manager for eSilicon Corporation.

Vincent’s engineering background gives him unique insight into the intellectual property field. He is fully aware of the extensive work and capital that goes into product research and development and he is committed to protecting the technologies of his clients. Vincent uses his technical background and litigation experience to assist clients in all phases of intellectual property disputes in a variety of forums, including district courts in California, Texas, and Delaware, the U.S. International Trade Commission, and the U.S. Patent and Trademark Office.

  • Representing international consumer electronics company in two different patent infringement cases involving 11 patents relating to LED and smart devices technologies (N.D. Ill.; W.D. Tex.)
  • Defending global microprocessor manufacturer in two different patent infringement cases involving patents relating to memory, microprocessor, bus interface, and semiconductor fabrication technologies (D.Del.; W.D. Tex.)
  • Defended multinational technology company in a 10-patent case involving GPS, wireless authentication, mobile communication, and camera technologies (E.D. Tex.); successfully settled
  • Successfully resolved case involving technology relating to the tracking of digital media presentations for a broadcasting subsidiary of a multinational media and entertainment conglomerate (C.D. Cal.)
  • Successfully defended multinational technology company in a patent infringement case involving 16 patents relating to features of smartphones, tablet devices and portable media players (D.Del.); case settled on favorable terms after 15 out of 16 patents were determined to be invalid or not infringed after two jury trials in the District Court of Delaware and associated appeals
  • Successfully settled patent infringement litigation relating to alleged improvements to clocking architecture used in DDR3 and DDR3 SDRAM memory after identifying key prior art that demonstrated invalidity of the patents (E.D. Tex.)
  • Defended patent infringement case involving 15 patents relating to multi-chip stacking and integrated circuit packaging technologies (D.Del.)
  • Represented multinational technology company in two patent cases accusing mobile devices, computers, apps, and other products and service, of infringing multiple patents (N.D. Cal.); successfully invalidated 3 patents on Alice motions to dismiss; conducted oral argument on PTAB IPR proceedings on 4 patents when case settled favorably
  • Defended international consumer electronics company in patent case accusing smartphones of infringing eight patents related to optical image processing and proximity sensing (E.D. Tex.); case settled on favorable terms shortly before trial
  • Represented multinational consumer electronics company in high-stakes patent case accusing smartphones, tablets, and laptop computers of infringing nine patents relating to graphics processing and memory management technology (E.D. Tex.); plaintiff dismissed seven patents after claim construction and case settled favorably
  • Successfully defended multinational technology company in a patent infringement case involving power supply identification technology (C.D. Cal.); served as lead IPR counsel against patent that resulted in invalidation; case dismissed after the Federal Circuit affirmed invalidation of patent-in-suit
  • Represented international consumer electronics company in asserting patent infringement claims involving GPU technology in multi-jurisdictional patent dispute (E.D.Va.); case settled favorably after the first trial and as the parties were preparing for the second trial
  • Represented international consumer electronics company in patent infringement matter involving 19 patents relating to microprocessor SIMD instruction sets (E.D. Tex.); case settled shortly before trial
  • Successfully resolved patent matter relating to microprocessor instruction sequencing and accusing a wide array of devices and products containing certain types of chipsets (E.D. Tex.); case settled shortly after O’Melveny team obtained a favorable Markman decision
  • Defended computeral peripherals company in complex multi-defendant patent case involving multiple patents alleged to cover the IEEE 802.11 WiFi standards (E.D. Tex.); the case settled on favorable terms
  • Secured a dismissal for computer peripherals company in multi-defendant case in which the plaintiff accused the defendants' Universal Serial Bus (USB) products of infringing its patent after successfully invalidating the asserted patent through an ex parte reexamination proceeding (D.Wyo.)
  • Represented global microprocessor manufacturer in high-profile, high-stakes antitrust litigation against competitor resulting in record-setting US$1.25 billion settlement in favor of client (D.Del.); case required highly complex and detailed analysis and understanding of the microprocessor industry, server, desktop, and mobile platform design, manufacturing capacity and other related issues

U.S. International Trade Commission Matters (Section 337 Investigations)

  • Defended international consumer electronics company in an ITC investigation on patents relating to semiconductor wafer-level packaging; the parties reached a favorable settlement after we successfully obtained a dismissal of the ITC investigation
  • Represented international consumer electronics company in two ITC investigations involving the assertion of multiple patents related to liquid crystal display technology against a competitor and the defense of patent claims by competitor; the parties reached a favorable settlement that included a significant payment to our client
  • Defended multinational technology company in an investigation involving three graphics and display patents; investigation terminated after favorable settlement
  • Defended global microprocessor manufacturer in an ITC Investigation involving patent infringement allegations against graphics processing units and memory controllers; investigation terminated after favorable settlement

  • Represented global microprocessor manufacturer in over 30 Inter Partes Review proceedings challenging the validity of patents relating to microprocessor design and semiconductor fabrication technologies; served as first chair at hearing before the Patent Trial and Appeal Board
  • Represented international consumer electronics company in 21 Inter Partes Review challenging the validity of patents relating to a wide range of semiconductor fabrication, display, mobile communication, and wireless technologies
  • Represented multinational technology company in 20 Inter Partes Review and Covered Business Method proceedings challenging the validity of patents relating to a wide range of mobile communication, Internet, video streaming, and authentication technologies
  • Represented gaming company in 5 Inter Partes Review proceedings challenging the validity of patents relating to video game and location tracking technologies
