Vision Winter


Vision Winter is a partner in O’Melveny’s Los Angeles office and a member of the Intellectual Property and Technology Practice within the Litigation Department.  His practice focuses on intellectual property litigation, primarily in the electrical, computer science, and electronics fields.  Vision is also a registered professional chemical engineer in the State of California and, before joining O'Melveny, worked at Procter & Gamble as a power and controls project engineer.  He has been named a “Rising Star” in intellectual property litigation in a survey conducted by Law & Politics Media Inc. and published in Los Angeles Magazine and the Southern California edition of Super Lawyers (2009-2013).

  • Represented a global microprocessor manufacturer in an antitrust case involving claims of unlawful monopoly maintenance in the worldwide x-86 microprocessor market; obtained historic US$1.25 billion settlement and wide-ranging injunctive relief
  • Represented a consumer electronics company in a Section 337 ITC investigation involving patents related to digital television technology
  • Represented a manufacturer and supplier of audio, video and computer peripherals and accessories in a multi-defendant patent infringement action in the Western District of Washington involving keyboard-video-mouse (KVM) switch technology
  • Representing a major military defense and aerospace company in defending a patent infringement action involving particle detectors used in military and other applications for portable toxic gas detection
  • Represented global microprocessor manufacturer in cases before the U.S. International Trade Commission and the Northern District of California in which plaintiff alleged that its trade secrets were stolen and used to make electrical circuit components that infringed three patents relating to DC-DC power controllers; cases successfully settled with a freedom-to-operate agreement
  • Represented a global supplier of microprocessors in an Eastern District of Texas patent infringement litigation alleging infringement of 12 patents relating to the operation of the floating point unit at the core of the client’s microprocessors; favorably settled
  • Represented a designer and manufacturer of orthodontic appliances in defending a Section 337 ITC investigation involving software and technology used to manufacture clear dental aligners; favorable settlement included substantial payment to the client
  • Represented a company providing integrated credit and debit card payment processing, electronic check conversion, and related software applications, products and services, in defending patent infringement allegations involving technology used in point-of-sale check processing systems; settled for nuisance value on the eve of trial
  • Represented a manufacturer and supplier of MP3 player accessories in defending a patent infringement matter involving FM transmitters that allow an MP3 device to transmit its signal to, and play through, a radio receiver; exemplary briefing on summary judgment led to a settlement on extremely favorable terms
  • Representing a consumer electronics company in a Section 337 ITC investigation involving patents related to digital television technology
  • Representing a consumer electronics company in a patent infringement case involving sixteen asserted patents relating to features of smartphones, tablet devices and MP3 players
  • Represented an international consumer electronics company in two related International Trade Commission Investigations and two related district court actions in a multi-patent dispute relating to LCD technology
