O’Melveny helped AIG obtain a favorable settlement of a lawsuit filed by Kevin Fitzpatrick, the former CEO of AIG’s real estate business, who claimed that he was entitled to a profit interest in every real estate asset that the insurer owned worldwide during his 22-year tenure. Fitzpatrick claimed money damages of approximately US$250 million and a declaration that he was entitled to a profit interest in numerous unsold properties. O’Melveny replaced AIG’s existing counsel a few months before trial. After winning several pre-trial motions, O’Melveny helped AIG secure a favorable settlement.
