Exar Corporation
O’Melveny represented Exar Corporation in its lawsuit against a former Vice President of the company for using trade secrets and highly confidential information to solicit a team of engineers to work for a new competitive venture in Hangzhou, China started by another former Exar employee. Prior to and after his departure, the defendant attempted to solicit several hardware and software engineers in Exar’s Freemont, California and Hangzhou, China offices using Exar’s confidential and trade secret information. Within a few weeks of filing the complaint, after conducting interviews with the defendant and other key witnesses, as well as discovering documents damaging to the defendant’s position, we were able to obtain a settlement in which the executive promised, among other things, to pay Exar over $100,000 in attorneys’ fees, to not solicit any Exar employees for one year following the execution of the agreement, to not work for the company for whom he was soliciting the employees, and to cooperate with Exar in its lawsuit against the new competing company that will be filed in China.
