O’Melveny secured dismissal of a proposed class action alleging that certain Kia vehicles were defective because the placement of the fuel tank under the rear passenger seat purportedly increases the likelihood of a catastrophic fire in a collision. The plaintiffs sought to certify a nationwide class action under California’s consumer protection and warranty laws. But the federal court in the Central District of California granted O’Melveny’s motion to dismiss all the claims with prejudice.
