O’Melveny won full dismissal for United Airlines, Inc. of a putative class action filed by a group of pilots on behalf of themselves and a proposed class of 490 pre-merger United pilots. The plaintiffs alleged that the calculation of longevity credit under the joint collective bargaining agreement governing both pre-merger United and pre-merger Continental pilots breached the 2010 merger agreement between United and Continental and also that it constituted a breach of the union's duty of fair representation and that United was complicit in that breach. In its motion to dismiss, O'Melveny argued the district court lacked jurisdiction over the pilots' claims because they raised "minor disputes" under the Railway Labor Act involving interpretation and application of a collective bargaining agreement. The Court agreed, granting our motion in its entirety.
