US Airways sued the US Airline Pilots Association (USAPA), the union that represents the airline’s approximately 5,000 pilots, alleging that USAPA had been engaging in an illegal slowdown in order to give the union greater leverage in its collective bargaining negotiations with US Airways. USAPA argued that the pilots’ actions were safety-related, and were not part of an effort to exert pressure on US Airways for purposes of bargaining. Following two days of hearings, a federal court in Charlotte granted US Airways’ request for a preliminary injunction and rejected USAPA’s safety rationale. Three months later, a court order was obtained converting the preliminary injunction to a permanent injunction, and final judgment was entered in favor of US Airways.
