Rudzin Named Litigator of the Week by AmLaw Litigation Daily

O’Melveny partner Abby Rudzin was named Litigator of the Week in the January 4, 2018, issue of The AmLaw Litigation Daily for securing a victory for client E-Commerce Dangdang Inc., a Beijing-based online retailer, in a putative class action by investors.

The case hinged on the fact that the investors had filed suit in Manhattan federal court rather than the Cayman Islands where Dangdang is incorporated. As US District Judge Katherine Polk Failla noted in her decision, most of the claims in the case relate to events outside of the US.

“The decision was a big win for Rudzin, in an area of the law coming under greater scrutiny as investors cross national boundaries to seek out opportunities in growing markets,” AmLaw observed.

“These investors do this with eyes wide-open,” Rudzin told the publication. “They’re doing it chasing higher returns because the Chinese e-commerce industry has exploded…You want to chase that return, but you don’t want to take the other side of it, which is: if you don’t like how the company is managed, you have to sue in the Cayman Islands.”

Rudzin is a seasoned litigator with more than two decades of experience representing financial institutions and Fortune 500 companies and their officers and directors in high-stakes litigation matters, primarily in the securities and antitrust arenas.
