Bloomberg Law: Virginia’s Physician-Only Law Falls for First-Term Abortions

Under a new decision in the US District Court for the Eastern District of Virginia, advanced practice clinicians will be permitted to perform first trimester abortions in Virginia. The federal court found that a state law saying that only licensed physicians could perform first-trimester abortions creates substantial obstacle for women’s health. However, the state held that due to an increased risk of complications in the second trimester, the physician-only law stands in these cases.

O’Melveny, the Center for Reproductive Rights, the ACLU of Virginia, and the Planned Parenthood Federation of America successfully represented the plaintiffs.
