Courthouse News Service: High Court Rules Texas Billboard Law Doesn’t Violate First Amendment

The US Supreme Court handed the city of Austin, Texas a win as it ruled in favor of its billboard regulation law, reversing a Fifth Circuit decision. The high court found that the law “that regulates signs for on-premises goods and services differently from signs advertising something at a different location is content-neutral on its face and does not infringe on free speech rights.” O’Melveny partner Michael Dreeben, who represents the city of Austin, argued that a law is only content-based if it treats signs differently based on their content.
