Courthouse News Service: High Court Sides with Medicaid Fraudster in Identity Theft Case

The US Supreme Court ruled today that a Fifth Circuit decision deeming psychologist David Dubin's health care offense as “aggravated identity theft” was incorrect, vacating an additional two-year sentence to his conviction. In 2019, Dubin was sentenced to three years in prison on health care fraud and identity theft charges after being found guilty of filing a fake Medicaid reimbursement form. Dubin is represented by Jeffrey Fisher of O’Melveny & Myers LLP.
