Deadline.com: Fox Hits Back at Netflix in Exec Poaching Battle; Wants US$1 if Suit Ends Before Trial

New motions have been filed in the three-year legal fight between Fox and Netflix. Fox claims that Netflix illegally poached two executives while encouraging them to break their contracts.

“‘Disrupting’ Fox’s contracts by inducing their breach is unlawful in this state, as Netflix well knows. Having no real defense, Netflix seeks to avoid liability by boldly asserting that Fox’s employment contracts -all of them- are unconscionable and against public policy, thereby permitting Netflix to freely disrupt them – all of them,” said Fox’s latest motion from O’Melveny’s Daniel Petrocelli, David Marroso, and Molly Lens. “If Netflix wants to achieve a wholesale change in California law, it must lobby the Legislature in Sacramento rather than resort to self-help and violate the law. In the meantime, this Court in Santa Monica should grant summary judgment in favor of Fox.”
