Judge Denies Sabre’s Appeal Against O’Melveny Client US Airways

According to a March 21, 2017, Law360 article, a New York federal judge denied Sabre’s appeal to overturn a US$15 million award handed to US Airways after a jury found the travel technology company restrained trade through unfavorable contract terms. The judge ruled that Sabre had not presented sufficient facts to undermine the evidence that led to the verdict. 

“Sabre’s argument ignores weeks of trial testimony, the factual context in which the 2011 agreement arose, US Airways’ actual argument, the court’s causation instruction, and the well-worn legal principle that jury instructions are to be ‘taken as a whole,’” the judge said. 

US Airways is represented by O’Melveny partners Charles Diamond, Andrew Frackman, Katrina Robson, and Edward Moss. Diamond is the senior partner of O’Melveny’s Century City litigation group, which he founded 25 years ago. Antitrust partners Frackman and Moss are based in the firm’s New York office, and Robson is based in Washington, DC.
