Law360: 6 Tips For Employers Tackling Post-Virus Telework Requests

O’Melveny partner Adam Karr is quoted in this Law360 article, which discussed the Equal Employment Opportunity Commission’s (EEOC) guidance on how businesses can handle telework requests going forward after their operations moved remotely amid the COVID-19 pandemic.

The EEOC advises that an employees’ request “does not have to be granted if it requires continuing to excuse the employee from performing an essential function,” Law360 reported. However, experts noted company leadership will have to inform employees what their jobs will look like going forward and if their role will require a return to the workplace.

“I think what the pandemic has taught us is that in a lot of circumstances remote work is possible,” Karr said. “So to the extent that physical presence is an essential function of a job position, that needs to be clearly delineated by the employer.”
