Law360: Big Tobacco Wins 3rd Delay Of Graphic New Warning Labels

Three major tobacco companies received a favorable decision regarding new FDA-mandated health and safety warning labels for cigarettes after US District Judge J. Campbell Baker pushed the companies’ compliance deadline to April 2022, ninth months later than the FDA’s initial target date of June 2021, reported Law360.

According to the publication, “[t]he companies argued that they would suffer irreparable harm if they were forced to spend millions of dollars on new labels to comply with a rule that could be invalidated” in separate litigation. 

Liggett Group, one of the plaintiff tobacco companies, was represented by O’Melveny partner Meaghan VerGow and associate Scott Harman-Heath.
