Law360: Calif. Justices Back Right to Counsel in Prosecutor's Appeal

The California Supreme Court ruled unanimously that indigent defendants have a right to court-appointed counsel on a pretrial appeal. The judges determined that a pretrial appeal of suppression order is a critical point of a case and thus entitles a defendant to counsel under the state constitution.

O’Melveny partner Brett Williamson, who represented The Innocence Project in an amicus brief, believes this decision is fundamental in “making sure there are procedural protections to ensure that innocent defendants aren’t wrongfully convicted.”
