Law360: Kesha Says New NY Free Speech Law Could Cost Dr. Luke

Musical artist Kesha argued that New York’s anti-SLAPP legislation enables her to counter-sue her former producer Dr. Luke for damages, this article reported. 

After Kesha’s rape allegations in 2014, Dr. Luke sued the artist for defamation. The publication noted that under the new anti-SLAPP law, which is aimed at protecting free speech from frivolous lawsuits, Dr. Luke’s claims must now clear a higher bar by proving Kesha’s “statements were made with actual malice,” a feat the artist argues the plaintiff cannot accomplish.
