An O’Melveny team led by Dan Petrocelli, chair of the O’Melveny’s Trial Practice Committee, secured a major victory for Manny Pacquiao in litigation arising from the 2015 “Fight of the Century” against Floyd Mayweather Jr., this article reported. The lawsuit alleged that Pacquiao cheated fans by not disclosing a shoulder injury he had at the time of the fight.
Pacquiao did not need to have disclosed a recent shoulder injury before the fight started, Circuit Judge Jacqueline H. Nguyen ruled. “The nature of competitive sports is such that athletes commonly compete — and sometimes dramatically win — despite some degree of physical pain and injury,” Nguyen wrote. “Taken to its logical extreme, Plaintiffs’ theory would require all professional athletes to affirmatively disclose any injury — no matter how minor — or risk a slew of lawsuits from disappointed fans.”
