Modern Healthcare: Biden’s DOJ Will Prioritize Fighting White-Collar Crime, Top Official Says

The Justice Department’s second in command, Deputy Attorney General Lisa Monaco, said that the department is making changes to fight corporate wrongdoing and that cracking down on white-collar crime will be a priority under the Biden administration. The DOJ will now consider past civil and regulatory enforcement actions that were brought against companies. O’Melveny partner Ben Singer discussed the significance of this saying that, until now, companies were able to operate under a corporate integrity agreement and that any non-criminal matters would have been disregarded by the DOJ for purposes of a criminal resolution. He also noted that healthcare companies tend to have more civil and regulatory enforcement actions in their history because they operate in a highly regulated environment.
