O’Melveny Lawyers Author Law360 Piece on Vitamin C Antitrust Litigation

O’Melveny partners Ian Simmons and Nathan Bush, counsel Julia Schiller, and associates Remi Moncel, Clarke Edwards, and Benjamin Hendricks co-authored the Law360 article “International Comity Saves Vitamin C Defendants” published September 28, 2016. The article discusses a Second Circuit decision in In re Vitamin C Antitrust Litigation that vacates a US$147 million judgment against Chinese vitamin C manufacturers that admittedly conspired to fix prices and output in violation of the Sherman Act. 

“The decision shows that American courts may be increasingly likely to dismiss US antitrust claims against foreign companies based in countries with heavy government involvement in the economy,” the authors conclude.

Simmons is co-chair of O’Melveny’s Antitrust and Competition Practice and resides in the firm’s Washington, DC office. Bush is based in O’Melveny’s Singapore office and specializes in internal investigations and disputes involving antitrust and competition, fraud and corruption, and international trade policy. Schiller resides in the Washington, DC office and specializes in complex antitrust litigation, government merger and non-merger investigations, and antitrust counseling.
