O’Melveny Team Authors Corporate Counsel Article on Congressional Investigations

O’Melveny & Myers’ K. Lee Blalack, David Leviss, and Zachary Kaufman penned an article on congressional investigations in 2013 for the June 6, 2012, edition of Corporate Counsel. This is the latest in a series of columns from O’Melveny lawyers examining the intersections of the political and legal worlds in the run-up to Election Day 2012. The article gives a background into congressional investigations, as well as the authors' predictions for an era of public and highly charged congressional investigations to continue for the foreseeable future. The article gives a to-do list of advice for general counsel of companies facing investigations including: treat a congressional inquiry as an adversarial investigation, carefully coordinate within your organization to prepare your response, do not delay, do not use an investigation as a lobbying opportunity, remember that congressional oversight is not litigation, know the rules of the road, and consider how a response to a congressional inquiry may affect a company’s strategy and potential defenses in multiple actions.
