O’Melveny’s Beddow Quoted in Law360 on Tips for Handling Government Investigations

O’Melveny & Myers partner David Beddow was quoted in a March 17, Law360 article, titled “5 Tips for Deal Markers to Smooth the 2nd Request.” The article discusses tips and strategies in speeding up the merger review process and potentially improving outcomes when dealing with Federal Trade Commission and US Department of Justice investigations, including narrowing down the second request. “It happens occasionally, more than occasionally, that even though we know the government’s main concern relates to only one product, to be conservative and to preserve their flexibility, they add in other products in the relevant product definition,” Beddow said, emphasizing the significant influence of the agency’s definition of the relevant product. “If they require parties to provide documents and data related to a range of products, the burden that can cause just in production and cost to the client can be tremendous.”
