O’Melveny’s Bush Authors Article in Competition Law International on China’s New Inter-Ministerial Committee

O’Melveny & Myers LLP partner Nathan Bush authored the article “SinoCFIUS: Same Wall, Same Guards, New Watchtower,” in the January 2012 issue of Competition Law International discussing how China recently established a new inter-ministerial committee modeled on CFIUS to review foreign acquisitions of control over Chinese businesses in sensitive sectors on national security grounds. While adding a hurdle for many covered deals with scant connection to national security, Bush writes, the new committee may actually streamline the resolution of genuine national security concerns. It remains to be seen whether ‘SinoCFIUS’ will target transactions with a clear nexus to national defence, or derail a broader range of deals based on an expansive notion of national security.
