O’Melveny’s Bush, Shan Co-Author Article on Increased Transparency of China’s NDRC

O'Melveny & Myers partner Nathan Bush and senior legal consultant Lining Shan co-authored "The NDRC Nudges the Transparency Dial" for the September/October 2014 issue of China Law & Practice.  In the article, the authors discuss recent signs that China’s National Development and Reform Commission (NDRC) is increasing transparency of its enforcement program by publishing penalty decisions for anti-monopoly violations.  “Publishing penalty notices will better equip the public to evaluate the NDRC's analysis and gauge the possible targeting of specific types of conduct or companies,” the authors explain.  They add that “[a]ny incremental gain in the transparency of the NDRC's enforcement program is a positive step.”

Bush resides in O’Melveny’s Singapore office and is a member of the Firm’s Antitrust and Competition Practice.  Shan resides in the Firm’s Beijing office.
