O’Melveny’s Erramouspe Quoted in Law360 on Streaming TV Case

January 02, 2013 Law360’s January 1, 2013, article, “Media & Entertainment Cases to Watch in 2013,” talked about the ongoing case WNET et al. v Aereo Inc. O’Melveny & Myers’ Matthew Erramouspe was quoted in the article on the potential ramifications for the television industry if the court finds that Aereo’s online streaming television service, which allows users to watch TV on a computer, doesn’t count as an unauthorized public performance. Erramouspe said that a ruling for Aereo could change the way digital rights are negotiated between networks and distributors. "The cable [and satellite] companies would be crying foul, saying, 'Look guys, Aereo can do this for free, so there is no way I'm going to continue to pay these exorbitant retransmission fees,'" Erramouspe said in the article. "They would say, 'We're going to talk about a much smaller retransmission fee.'"
