O’Melveny’s Fowler Quoted in California Lawyer on E-Discovery

O’Melveny & Myers LLP partner Jeff Fowler is quoted in the article “Gearing Up for E-Discovery,” which appears in the April 2013 issue of California Lawyer. According to the article, many lawyers have been slow to embrace predictive coding, an artificial intelligence technique for finding relevant electronic documents, despite its speed and cost advantages over typical keyword searches and manual review. As for the bench, while some judges publicly approve of computer-assisted review, other judges have required parties using predictive coding to provide a detailed account of their discovery process than would be required when using keywords and manual searches. "If that remains the case, that may have a chilling effect on the use of predictive coding," Fowler told the magazine. Fowler is one of the founders of O’Melveny’s Electronic Discovery and Document Retention Practice and resides in the Firm’s Los Angeles office.
