O’Melveny’s Hacker Recognized by National Law Journal for Brief of the Week

The National Law Journal named Jonathan Hacker’s petition for certiorari in Zurn Pex, Inc. v. Cox the brief of the week in its February 21, 2011, edition. In the brief, Hacker asks the Supreme Court to rule on the level of responsibility judges have when evaluating the reliability of expert testimony in class action certification. He raises concerns about a class action certification in Zurn Pex on expert testimony that wasn’t thoroughly vetted, according to the article. "It is illogical and inefficient to allow junk science to establish the course of litigation at the critical class certification stage when it would be excluded later in the process," Hacker wrote in the petition.
