The most recent edition of the Energy Law Journal features a lengthy authoritative article written by O’Melveny & Myers LLP counsel Hugh Hilliard on the scope of section 203 of the Federal Power Act, which requires parties engaging in certain transactions involving public utilities to obtain prior authorization from the Federal Energy Regulatory Commission (FERC), and the jurisdiction of FERC in relation to section 203.
