O’Melveny’s Leviss Quoted in The National Law Journal on Software Companies and the False Claims Act

O’Melveny & Myers senior counsel David Leviss is quoted in The National Law Journal’s November 14 article “Database blues,” which discusses Oracle’s recent settlement of a False Claims Act suit with the US government.

Leviss, a member of the Firm's White Collar Defense and Corporate Investigations Practice in Washington, DC, worked on a similar but unrelated False Claims Act case during his tenure as a Justice Department prosecutor.

Leviss noted that software companies in particular have had problems with compliance with govement rrequirements to disclose information about their commercial pricing. "There's a lot of wiggle room in profit margins," he explained, given that software is cheap to manufacture and that the majority of the costs occur during the development phase.
