O’Melveny’s Longo, Kahf Author Article on Spoliation of Unallocated Space

O’Melveny & Myers LLP lawyers Amy Longo and Usama Kahf co-authored the article “Hard Times for Hard Drives: The Spoliation of Unallocated Space” for the May 9, 2013, edition of Bloomberg BNA - Digital Discovery & e-Evidence Report. In the article, Longo and Kahf consider whether modifying, formatting, or wiping unallocated space is a sufficiently routine operation to trigger the protection from discovery sanctions provided by Rule 37(e) of the Federal Rules of Civil Procedure.
