O’Melveny’s Miller Quoted in Law360 on Increased Focus on Trade Secrets

April 02, 2014 O’Melveny & Myers partner Mark Miller is quoted in Law360’s April 1, 2014, article “Weakened Patent Rights Make Trade Secrets More Attractive.”  The piece focuses on how intellectual property strategies have shifted in response to several US Supreme Court decisions that have put strict limits on patents over the last decade.  According to the article, technology, life sciences, and consumer electronics companies in particular are focusing more on trade secrets to protect their innovations.  In recent years, patent owners have faced several new challenges, including the America Invents Act, which affects patents in inter partes review proceedings.  “Inter partes review has made patents more susceptible to challenge…To date, challenges in inter partes reviews have generally been successful,” Miller told the publication.

Miller is a member of O’Melveny’s Intellectual Property and Technology Practice within the Litigation Department, and resides in the Firm’s San Francisco office.
