O’Melveny’s Nicksin Quoted in Law360 on Prop. 65 Reform Bill

February 11, 2013 O’Melveny & Myers LLP counsel Bob Nicksin is quoted in the February 8, 2013, Law360 article “Prop. 65 Reform, Offered As Panacea, Could Prove Unpopular.” The article concerns a proposed bill that would give California businesses an opportunity to avoid litigation by addressing Proposition 65 violations reported by potential plaintiffs during a 14-day grace period.

Nicksin, a Los Angeles-based member of O’Melveny’s Energy, Natural Resources and Environment Practice noted that a business’ ability to adequately address issues within a two-week period may vary greatly depending on the type of business. "If you were a manufacturer of a product that was sold in hundreds of stores in California, based on the proposed bill, you would have to get out to each of those products and put warnings on them within 14 days," Nicksin said.

Nicksin is the co-author of a February 7, 2013, Client Alert issued by the Firm regarding the bill, available here.
