O’Melveny’s Parker Quoted in Law360 on Upcoming Supreme Court Competition Case

1月 02, 2014 O’Melveny & Myers partner Richard Parker was quoted in a January 1, 2014, Law360 article, titled “Competition Cases To Watch In 2014.”  Among the matters discussed in the piece is Mississippi v. AU Optronics Corp., an upcoming Supreme Court case in which Mississippi Attorney General Jim Hood is challenging a Fifth Circuit decision that several LCD manufacturers could force his price-fixing suit into federal court under the Class Action Fairness Act (CAFA).  According to the article, this matter involves the question of whether state parens patriae claims can be considered "mass actions" under CAFA.

The outcome will have a more tangible effect on defendants, Parker told Law360.  "It's dollars and cents… AGs are always looking for an opportunity to capitalize on money damages, and if they get to pick their forum, they do it for a reason: because they can get more money," he said in the article.
