O’Melveny’s Parker Quoted on SMARTER Act in Multiple Publications

April 03, 2014 O’Melveny & Myers partner Richard Parker was quoted in Law360, Global Competition Review, and The Deal Pipeline regarding the proposed Standard Merger and Acquisitions Review Through Equal Rules (SMARTER) Act of 2014. As the April 4, 2014, The Deal Pipeline article reports, the SMARTER act would remove discrepancies between FTC and DOJ merger review processes, which some say give the FTC disproportionate authority to halt transactions. In the April 4, 2014, Global Competition Review piece, Parker highlights his contrasting experiences litigating challenges by the FTC and DOJ. "It is fundamentally unfair and serves no legitimate enforcement objective for an 'FTC industry' to have a more difficult time in court than a 'DOJ industry,'" Parker said in the April 3, 2014, Law360 report. "As I know from experience representing clients, that is a very hard point to explain, much less defend, to an executive whose company happens to be an FTC industry for merger review purposes."
