O’Melveny’s Petrocelli is The American Lawyer’s “Litigator in the Spotlight” for March 2013

O’Melveny & Myers LLP partner Daniel Petrocelli was selected as The American Lawyer’s March 2013 “Litigator in the Spotlight” for his work representing Warner Bros. Entertainment in litigation over rights to the iconic Superman character filed by the heirs of co-creator Jerry Siegel. The spotlight notes that Warner Bros. asked Petrocelli to take on the case in 2009 following a loss in federal district court. Leading a team of O’Melveny litigators, Petrocelli convinced the US Court of Appeals for the Ninth Circuit to reverse that decision, arguing that the heirs had given up their statutory rights to reclaim the copyrights in a 2001 agreement. This victory came on the heels of a win against the heirs of Superman’s other co-creator, Joe Shuster, in federal district court. “Not bad for a guy who, as far as we know, doesn’t actually have any superpowers,” The American Lawyer wrote.
