O’Melveny’s Representation of Directors in Tortious Interference Case Noted in Law360March 07, 2012
A Delaware judge dismissed claims against a group of lenders, directors, and shareholders in a lawsuit stemming from the sale of the foreclosed ATM Acquisition Corp. to one of HIG Capital LLC’s affiliates, according to Law360’s March 6, 2012, article “Fiduciary Duties Stand Firm In LLC Pacts: Del. Court.” O’Melveny & Myers’ Tancred Schiavoni and Steve Warren represented a group of directors who were found not to be liable for tortious interference of a contract, after private equity firm Edgewater Funds filed a lawsuit against the former directors of ATM.
The case is Edgewater Growth Capital Partners LP et al. v. HIG Capital Inc. et al., case number 3601-CS, in the Court of Chancery of the State of Delaware.
