O’Melveny’s Simmons Named Law360’s Antitrust MVP

December 07, 2011

Law360’s December 7, 2011, “Antitrust MVP: O'Melveny & Myers' Ian Simmons” profiled O’Melveny’s antitrust partner Simmons for his work with Asiana Airlines, among other cases. Simmons argued in the Ninth Circuit that the “air carrier” designation applied to foreign carriers, which helped eradicate a class action lawsuit against Asiana Airlines and affirmed a previous dismissal of hundreds of millions of dollars in antitrust claims, according to the article. “That was the real highlight of the year,” Simmons said in the article. “We had the weight of policy behind us, but we had the statutory definition against us. We had to do a lot of clever and careful ... lawyering.”

Simmons also represented Samsung Electronics Co. Ltd. in the dismissal of an antitrust case alleging Samsung and other technology companies were fixing prices for optical drives. In the article, Simmons is described as “passionate” as he “fights for his clients.” He was attracted to antitrust law because, “there’s a lot of artistry in it because it is common law. It lends itself to creativity, but that creatively has to lend itself to rigor,” Simmons said in the article.
